比特币又火了一把,不过这次是因为银行发布的交易禁令。

近两日,中信银行禁止账户用于比特币交易一事登上微博热搜榜,这也是继2014年十余家商业银行集体“围剿”比特币后,又一家银行对比特币交易进行“封堵”。不过,北京商报记者多方亲测调查发现,目前多家币圈交易所仍面向国内用户开放C2C交易,其中交易渠道主要包括银行卡、微信、支付宝三类。在分析人士看来,目前,比特币交易在我国并不合规,存在多方面交易风险,建议普通消费者谨慎介入。

花样百出的C2C交易

再现银行祭出比特币交易禁令。5月7日,中信银行禁止账户用于比特币交易一事登上微博热搜榜,据该银行称,任何机构和个人不得将中信银行账户用于比特币、莱特币等的交易资金充值及提现、购买及销售相关交易充值码等活动,不得通过中信银行账户划转相关交易资金。一经发现,中信银行有权采取暂停相关账户交易、注销相关账户等措施。

不过,北京商报记者调查发现,目前,仍有OKEx、币安等多个头部币圈交易所面向国内用户开放交易,其主要作为平台的角色,为买卖方提供信息展示、交易撮合甚至交易担保服务。在支付渠道上,主要支持银行卡、微信支付、支付宝三类,且主要通过C2C个人转账的方式进行。

以OKEx交易所为例,目前该平台在官网和官方App均开设了买卖币快捷区和自选区,用户只需注册账号、上传有效身份证件,进行个人实名认证后,就可操作各类币种的买卖操作。

在快捷交易区,注册用户只需一键输入购买的人民币(6.4299-0.0033-0.05%)金额,就会显示购买相应币种的一定份额,支付方式可选择银行卡、支付宝或微信支付。其中,北京商报记者选择银行卡支付后,付款页面便会提醒用户打开银行卡向卖家转账,并详细告知卖家的姓名、银行账号、开户行等信息;此外,北京商报记者相继又选择了支付宝、微信支付两类支付渠道,操作大同小异,主要是通过个人支付宝账号转账或者微信收付款等方式进行。

值得注意的是,根据央行要求,各金融机构和非银行支付机构不得直接或间接为“虚拟货币”提供账户开立、登记、交易、清算、结算等产品或服务。基于此,多家银行、第三方支付机构也采取了一定措施进行交易监控。

例如,北京商报记者在通过支付宝对卖家进行转账操作时,备注“比特币”一词便会被提醒含有敏感词。或是为躲避支付通道的监控,OKEx平台在交易页面也会提醒“用户转账时,请勿备注任何信息,为确保及时到账,大于5万转账时,请分批转账。平台已担保该次交易”。

针对OKEx平台的这一C2C交易行为,北京商报记者向该平台进行求证,截至发稿,官方未给出回应,不过,一OKEx工作人员告诉记者,目前在自选区或快捷交易区的卖家都属于平台认证商家,已经向交易所缴纳相应保证金,买家只有在转账操作不备注任何信息,卖家才会正常放币,否则无法完成交易。

针对币安等交易所平台C2C交易情况,北京商报记者同样进行求证,但截至发稿,未给出官方回应。

有从业人士告诉北京商报记者,C2C交易转账不备注已经成为行业内“公开的秘密”,这一做法主要是为躲开多个支付通道的监控。

C2C交易买卖币,就像一场“猫和老鼠”的游戏,花样百出。北京商报记者注意到,既有卖家因为支付宝、微信支付等渠道被限制收款,要求买家进行银行转账付款的操作;也有卖家考虑到银行风控,提醒买家尽量不要转账,建议下单后加好友,通过发红包的方式进行交易。

“一方面,C2C个人转账并不需要告知用途,因此很容易披上普通支付的外衣,另一方面,比特币等虚拟币价值转移虽然可追溯,但其节点在比特币上交易是匿名加密的,所以,技术上很难追踪个人和个人之间的交易。”中南财经政法大学数字经济研究院执行院长、教授盘和林告诉北京商报记者,目前,比特币交易在我国并不合规,有一定交易风险,其既不能公开发售,也不能在法币和比特币之间转换,若支付平台对比特币交易所进行支付支持,对应的支付平台无疑是有风险的。

交易禁令与此前一脉相承

实际上,中信银行近期的比特币交易禁令,与此前一脉相承。

北京商报记者注意到,早在2013年12月,自央行等五部委联合发布《关于防范比特币风险的通知》,要求各金融机构和支付机构不得开展与比特币相关的业务后,2014年,包括建设银行、农业银行、浦发银行、广发银行、工商银行等十余家银行便先后表态,禁止使用账户用于比特币交易,停止一切与比特币有关的活动。

此外,包括支付宝在内的第三方支付机构也发布比特币交易“禁令”:任何机构和个人不得将公司各类支付服务用于比特币、莱特币等的交易资金充值及提现、购买及销售相关交易充值码等活动以及划转相关交易资金。

不过,目前比特币等虚拟货币被认可为虚拟商品后,市场也存在多个争议:为何多方禁令下,买卖币交易仍屡禁不止?如今被认可为虚拟商品的比特币,能否实现C2C交易?

“C2C转账交易,只是因为技术监管上的难度,以及比特币商品定位,从而开了一道口子。至少在中国法律看,当下比特币交易还没有完全合法化。所以,在国内银行和支付机构会和交易所划清界限。”盘和林如是向北京商报记者说道。

此外,一资深律师也说道,目前虚拟货币的定性并无定论,根据各虚拟货币交易价值、使用价值的不同,存在货币、数据、财物、商品等各种说法。根据其定性的不同,在应用上受到的法律评价会千差万别。目前公民持有比特币、以太坊等主流的虚拟货币与持有虚拟商品无异,也并不违法。但涉及买卖币交易等类金融业务,根据定性不同,结论不一,仍有待进一步观察探讨。

不过,一接近监管人士向北京商报记者表态,目前监管对虚拟货币整顿仍然保持高压态势,只要涉及到为国内消费者提供非法交易通道,就要被严惩;此外,不仅针对发币企业主体,且为注册在境外的虚拟代币交易平台提供引流、服务以及资金通道的企业均要打击。

“即使虚拟货币具有商品属性,但在监管明令打击虚拟代币交易的前提下,这种C2C交易行为仍属于灰色业务,触犯了监管红线。”前述接近监管人士透露道。

严防虚拟货币沦为洗钱工具

北京商报记者注意到,近两年来,多方监管加码打击虚拟货币交易行为。其中,北京、上海、深圳等多地监管就曾强调,将加大监管防控力度,打击虚拟代币交易,并将对辖内虚拟货币业务活动进行持续监测,一经发现立即处置,打早打小,防患于未然,对虚拟代币交易等非法金融活动严厉打击,坚持露头就打,持续保持监管高压态势。

“在公民参与虚拟货币与法币的交易过程中,由于交易所的法币交易多为点对点的交易模式,公民出售虚拟货币所取得的法币可能是犯罪行为人原本持有的赃款,却无法追溯源头。”在前述资深律师看来,监管、银行等多方限制虚拟货币交易,主要原因应该是出于反洗钱的需要,由于虚拟货币具有极强的隐蔽性与匿名性,某些犯罪行为人会利用虚拟货币作为洗钱的工具。

事实上,除了易被犯罪分子利用外,目前比特币等虚拟货币价格暴涨暴跌,极端行情不断上演,也有多方人士提醒要注意价格波动风险和投机风险。

正如中国人民大学高礼研究院助理教授王鹏所称,“比特币价格受全球金融监管政策及宏观经济环境等多重因素影响,价格飙升有很大炒作成分。尽管有些人通过炒币实现了所谓的财富增长,但更多情况是在目前的价格高位和极端行情之下,不乏庄家炒作和割韭菜的行为,普通投资者要审慎参与,从自身的能力水平和认知角度出发,切记天下没有免费的午餐,收益和风险永远是成正比的”。

另一分析人士同样说道,对于市场交易的参与者来说,一方面要考虑参与交易对应的法律风险,同时,大量热钱的进出、盲目的频繁交易,也容易对交易者造成财产损失,参与者也需要注意财务风险。
