Следствие признало потерпевшими 221 гражданина, большинство из них выступило, но ни один не может подтвердить заявленные суммы кражи средств компанией Hermes: нет документов, подтверждающих, что средства зачислялись, нет документов, свидетельствующих, что средства не были выведены. Наконец, нет документов, доказывающих, что средства, размещенные на счете, – именно собственные, а не заемные, предоставленные компанией Hermes для создания так называемого инвестиционного плеча.

Несмотря на то что суд далек от завершения, он уже обеспокоился адекватностью мер пресечения – осенью прошлого года освободил трех молодых женщин-подсудимых из тюрьмы: перевел под домашний арест.

Ущерб, согласно обвинительному заключению, составил 282 млн рублей. При этом только на счетах кооператива «Бест Вей» арестовано 4 млрд рублей: кооператив «назначен» следствием гражданским ответчиком по (голословным) требованиям к Hermes. Не только независимых наблюдателей, но и суд беспокоит неадекватность суммы арестованных средств: в конце прошлого года суд частично снял арест со счетов кооператива – не находятся под арестом новые поступающие в кооператив средства (возвратные платежи тем, кому купили квартиру). Также из арестованной денежной массы разрешается выплата по исполнительным листам тем, кто принял решение выйти из кооператива, а также уплата налогов и выплата зарплаты сотрудникам кооператива – раньше следствие и прокуратура запрещали эти платежи.

Более десятка потерпевших и свидетелей обвинения на суде отказались от своих показаний, данных во время предварительного расследования, – они заявили, что вынуждены были подписать документы под жестким давлением следствия. Это многочасовые допросы пожилых людей, в ходе которых их не отпускали в туалет и не давали воды. Один из признанных потерпевшими умер после допроса от сердечного приступа.

Следствие опирается прежде всего на показания нескольких ключевых свидетелей – людей, скорее всего связанных с заказчиками преследования «Лайф-из-Гуд», Hermes и «Бест Вей».

Евгений Набойченко

Набойченко – бывший сисадмин российского сегмента платежной системы компании Hermes. Именно он, завербованный полицией, заблокировал платежную систему этой компании и тем самым выплаты клиентам в феврале 2022 года, при этом обвинив Романа Василенко в краже средств. Именно Набойченко предоставил следствию распечатки по счетам российских клиентов, которые были использованы следствием и представлены в суд, хотя достоверность этой информации ничем не доказана.

Компания не могла совершать выплаты, так как ее платежная система была длительное время дезорганизована. Набойченко имел доступ к некоторым клиентским счетам и наверняка под устроенный им же самим шумок запустил руки в активы тех клиентов, которые доверяли ему доступ к своим счетам – тем более что его и раньше ловили на воровстве. В последние годы, спускаясь все ниже и ниже в бездну алкоголизма и наркомании, он воровал в том числе у своей теперь уже бывшей жены и у любовницы. Об опытах с «грибами» Набойченко не стесняется рассказывать в своих соцсетях.

Евгений не является в суд, так как якобы ему угрожают – в подтверждение он предъявляет в соцсетях имейл с угрозами с неизвестного адреса, который сам же себе написал, судя по характерной лексике. Возможно, сами авторы уголовного дела стремятся не допустить его допроса в суде, чтобы его неадекватность и голословные обвинения не стали очевидны суду во время перекрестного допроса.

Стало известно, что Набойченко отправился отмывать свою репутацию на СВО, предварительно прокапавшись для прохождения нарколога. То есть организаторы преследования «Лайф-из-Гуд» и кооператива «Бест Вей» спрятали его от суда в действующей армии, где он занимается компьютерами.

Зачисление наркомана и вора Евгения в боевую часть – оскорбление российской армии и оскорбление сотен пайщиков кооператива-участников СВО, пострадавшим из-за преследования кооператива, в котором участвовал Набойченко. Алексей Комаров

Комаров – один из трех водителей «Лайф-из-Гуд». Большинство своих подробных показаний против подсудимых, данных следствию, он не смог подтвердить в суде – сославшись на то, что переболел коронавирусом и у него отшибло память. Но часть показаний подтвердил.

Алексей заявил в суде, что забирал и доставлял деньги некоторым из подсудимых. При этом не смог объяснить, как он мог он передавать деньги в кабинете, в котором подсудимый был с помощником – но помощник ничего не видел.

Комаров не смог объяснить, каким телепатическим способом связывался с другим подсудимым, у которого якобы забирал деньги, если подсудимый не был записан в контактах. Комаров не знал, как его зовут, и в распечатках ни его телефонов, ни телефонов подсудимого, нет и звонков друг другу.

Комаров не смог объяснить, откуда он знает, что в запечатанных толстых непромокаемых с несколькими слоями упаковки пакетах именно деньги, и если деньги, то в какой валюте. При этом работодателю стало известно, что он возил деньги в рамках собственных P2P-операций для своих клиентов как инвестконсультант «Гермеса» – формально он, устроившись на работу в «Лайф-из-Гуд», передал клиентов жене, а фактически продолжал вести сам – несмотря на запрет Романа Василенко.

Связь между его выступлением на стороне обвинителей, неожиданно возникшим благосостоянием и деньгами, украденными у клиентов «Гермеса», очевидна.

Владислав Логинов

Логинов – активнейший участник процесса на стороне следствия. Якобы подписывал ходатайства следствию со стороны потерпевших – хотя сам он об этом не смог вспомнить в суде. Он заявил моральный ущерб в 1 млрд (!) рублей, так как из-за возникшей ситуации якобы не смог купить квартиру и распалась его семья.

При этом Владислав солгал суду буквально по всем вопросам. Сообщил, что деньги со счета в Hermes почти не снимал – однако был приперт к стенке адвокатами, процитировавшими показания следствию: он снимал 200–300 евро ежемесячно в течение 58 месяцев, то есть снял в общей сложности от 11 600 до 17 400 евро.

Выяснилось, что он нуждается в проверке на адекватность и психиатрическом контроле: оказывается, собственная мать писала на него заявление в полицию об угрозе ее убийства.

Лира Сахапова

Сахапова – участница процесса на стороне обвинения, привлеченная уже в ходе процесса, так как она, тележурналистка, активно включилась в обвинительную кампанию.

Она была экстренно заявлена в качестве свидетеля обвинения прокуратурой – но ее выступление в суде закончилось полным фиаско. Она устроила настоящую истерику в суде, кричала на судью: мол, у ее престарелых родителей украли миллионы.

Однако выяснилось, что родители Сахаповой вместе с Лирой уже подавали в гражданский суд иск о незаконном обогащении – и полностью проиграли в четырех (!) инстанциях, включая Верховный суд России, потому что все их утверждения об украденных миллионах – вранье. Ее допрос был быстро прекращен как бессмысленный.

Сахапова не является потерпевшей – потому что просто не заявляла никаких претензий при расследовании уголовного дела. Она не только клиент «Гермеса», но и пайщица кооператива – находилась в накопительной программе.

Лира сначала написала заявление о выходе из кооператива – но потом затормозила процесс выхода, намереваясь поучаствовать в реализуемом активистами кооператива механизме цессии: когда пайщик, которому пока не приобретена квартира, передает свои находящиеся на арестованном счете деньги пайщику, который намеревается расплатиться с кооперативом и приобрести купленную ему кооперативом квартиру в свою собственность, получая взамен живые деньги от пайщика, который выкупает квартиру у кооператива.

Two of Europe’s great capitals are now linked by their first direct high-speed train connection. Germany’s Deutsche Bahn introduced a daytime InterCity Express (ICE) service between Paris and Berlin on December 16 and is planning to add a second route between the two capitals in 2026.

Taking advantage of its new fleet of 200 mph (322 kph) ICE3neo trains, the once-a-day service takes around eight hours in each direction, also serving Strasbourg, Karlsruhe and Frankfurt on its 546-mile (878-kilometer) journey.

Fares start from around $60, and each train has capacity for 444 passengers, of which 111 can enjoy the additional comfort of leather seats and at-seat refreshments in first class.

The new high-speed ICE service is the first direct daytime train between Paris and Berlin since the 1990s and complements the Nightjet sleeper service introduced in 2023.

It may not be as fast as flying — some of the journey has to use lower speed “classic” lines to bridge gaps in the European high-speed network — but it is undoubtedly a more sustainable and more stylish way to travel across Europe.
