机构性质：政府机构
机构介绍：FINMA成立于2009年，其前身是瑞士联邦银行委员会(SFBC)、联邦私人保险办公室(FOPI)和反洗钱监管局(AMLCO)。在建立FINMA的过程中，立法者将金融市场监管的责任移交给了一个综合的权力机构。
FINMA是拥有独立法人的独立机构，其总部设于瑞士首都伯尔尼。它直接效命于瑞士议会，从机构上、功能上和财务上独立于瑞士的联邦中央政府和联邦财政部。执行金融市场监督法案，负责金融市场的立法。按照FINMASA法案Art. 5 规定，FINMA的职责是保护债权人，投资者和投保人的利益，同时保证金融市场的正常运作。FINMA使命的核心是为个人提供保护，维护金融市场的功能。
该管理局整合了联邦私人保险管理办公室(FOPI)、瑞士联邦银行业委员会(SFBC)以及瑞士反洗钱控制委员先前的职能，全面负责瑞士所有的金融监管。
在瑞士，只要是接受存款用于第三方融资的交易都叫银行业务活动。所以，所有的外汇交易商必须具有银行资质，才能进行外汇交易。银行也保留了为客户执行外汇交易的权利，也就是所有FINMA授权的银行都能提供外汇交易业务。
组织架构
FINMA被分为八个部门。监事会的战略管理由董事会执行。经营管理的责任在于执行董事会。
董事会和执行董事会
FINMA是一个独立的监管机构，它拥有一个由董事会、执行董事会和外部审计师组成的现代管理结构，其形式是瑞士联邦审计署(SFAO)。
作为FINMA的战略管理机构，根据《金融市场监管法案》，董事会由7至9名独立专家组成。它决定重要的事项，发布条例和通告，并负责FINMA的预算。它还通过内部审计单位和监督执行局来确保内部控制。
执行工作由执行董事会管理，执行局由九名成员组成：一名行政长官和八名各司司长。执行局准备必要的文件和材料，供董事会作出决定，并负责执行本管理机构的决议。对于不属于董事会的所有事项，执行委员会都有自己的决定。
员工人数
2016年，FINMA平均雇佣了513名员工，相当于477名全职员工。
它的工作人员由广泛的专家组成，他们在一个跨学科的基础上共同工作。FINMA聘请了来自法律、经济学、数学、审计、精算专业、会计和投资等领域的专家。
监管职能
监督金融市场和金融机构；FINMA受命保护金融市场客户——债权人、投资者和保单持有人——并负责确保瑞士的金融市场有效运转。此外，FINMA还可以规范授权的活动。在执行监督活动时，FINMA采取了系统性风险导向的方法，并注意确保连续性和责任性。
监管范围

FINMA为瑞士金融市场的利益和债权人、投资者和保险客户的利益进行监督活动。FINMA监管瑞士金融市场的首要目标是确保它们正常运作，并确保金融机构的所有客户都能免受其破产的影响。

FINMA是一个公共法律机构。它的目标是在《金融市场监管法案》(Financial Market Supervision Act)中提出的，该法案要求它保护个人金融市场客户，并确保瑞士金融市场正常运转。这两个目标是相互依存的，因为金融机构本身依靠其客户的信任来维持其在国际舞台上的竞争优势。

FINMA的核心目标之一是保护金融机构的所有客户——债权人、投资者和保单持有人——反对机构破产、不正当的商业行为，并确保公平的股票交易执行。个别客户提出的索赔不能由FINMA决定。他们必须通过民事法律程序解决，或者由申诉专员在仲裁程序中解决。
（2）促进金融市场的声誉
FINMA的监管活动也有助于提高瑞士金融市场的竞争力和声誉。FINMA实现这一要求的目标是遵循专业标准，并采取一致的方法来执行其监督职责。它的最高目标是采取独立和可信的行动，适当考虑风险，维护法律，并在国家和国际一级维持适当的接触网络。
